What should I do about underwater home – mortgages?

I live in SW Florida where I owe $335,000 for a house surrounded by homes forecloure specialists are enjoying profits from selling at $125,000 (in much better condition than mine), and at least another thousand brand new unoccupied homes nearby. Flood insurance just became mandatory and rates went up.
I bought in ’06, it was the best I could get then, but in very poor shape compared to the quality of currently available homes. It would take another $20,000 just to make it marketable to sell for $125,000.
In ’06 I had to have two loans on teacher pay, did not have enough reserves for a down payment, assumed value would continue escalating and would refinance/consolidate both loans, with increased equity in a few years, and live here another ten years, retire and go home and live in Texas in a modest, low cost home, for the rest of my life.
Disaster struck.
I modified loan 1 (SAXON) under HAMP – that one payment is 31% of my gross income – one of my 2 “take home” paychecks a month.
I modified Loan 2 ($65,000 balance) directly with OCWEN, who only gave me a reduced rate (14% TO 2%) for 5 years.
My entire 2nd paycheck is that payment, utilities, food, clothes, car, gas, credit cards, student loans, and other living expenses.
I live hand to mouth and see now that I will never be able to retire/sell this house/move home, etc.
I didn’t want to get rich, but I didn’t expect to pay every dime I make for the rest of my life for basic living because of what I perceive as a national financial disaster – obviously not just a “natural real estate cycle” – evolving from poor economic planning and oversight on the part of the politicians who have been paid by my taxes from my hard work for the last 35 years to assure my (at least basic) quality of life – for life.

It is hard to specify ethical boundaries under such extreme, outlying conditions.
I do know one thing about this crisis:
Ethcial boundaries were crossed at every stage, by many people, over many years.
The argument for the end consumer to suffer – in such an exaggerated way – in order to affirm their ethics – seems profoundly hypocritical.
On the other hand, I am still here, paying my mortgage, even though every other homeowner who purchased a home in this HOA between ’05 and ’08 has walked away, so I AM demonstrating ethics.

My question is, “What would you do?”

I wish I could put up a poll and ask every expert what they would do.
Walk away entirely? What then… ? Rent for life…?
Stop paying 2nd lien? What then…? Credit ruined…for how long…? What else….?
Swallow and pay every dime they earn to live a restricted (since ’06: never go out, no travel, no vacations, no gift giving at holidays, drive old cars, buy used clothes, etc.) life for the next ten or fifteen years, fearing job loss or pay cut daily, only to find out at retirement that I have to walk away from it then, can’t sell it, perhaps have to file bankruptcy, then, and live in government housing for my retirement…?
That seems awfully bleak.
I make too much, they say, to file bankruptcy. hmmm…what would you do?

There is really no easy answer. You have done all you can possibly do, but the end of this recession and all that it entails may still not be in sight.

It is probably time to walk away from the mortgage. You could list the house for sale with a Realtor’s help, at a price at which it is likely to sell. Then have the Realtor help you present any offer to the bank as evidence of a short sale.

The problem with that, of course, is that the bank is likely to try to place a lien against you for the deficit. So, your only option may be to walk away. It will hurt your credit for 7 years, but the options are so limited that there may be no other solution.

You can stop paying the mortgage and use that money to hire a lawyer to help you sort this thing out. It is such a shame that good people are being financially devastated by the economy’s downturn.

Frankly, I don’t see any other solution. You truly have done all you can possibly do. Ethics are one thing. Poverty is another. Get a lawyer and start packing.

I was wondering if you are able to drive a vehicle that is currently insured by your parents name. I have a friend who said as long as the vehicle is insured its okay to drive it by Florida law. Do you need insurance in your own name to drive a car that is already insured? (the insured policy is 10,000 liability and 10,000 body)

If the vehicle is provided for your regular use, then you have to be listed on the policy as a driver.

That’s not because of a law. It’s because of the language in the policy.

It’s pretty standard for the auto policy to have language in it that says if the vehicle is provided for your regular use and you are not listed on the policy, then your company can deny coverage. That means, you would end up being personally responsible for any damage/injuries you cause.

Why come Florida doesn’t require bodily injury liability. I recently post a ? yesterday found out it was Florida instead of GA. Now my uninsured motorist got to take care of my wife injuries and he get off easy. They provided us a rental car and pay us for our loss car but nothing else. So I guess anyone who lives in Florida could hit onyone and get away with it. I was wondering if the insurance company has anything else where I could filed this clam under.

You can buy insurance that will even when the other side does not. It is called UM (uninsured motorist) coverage.

Since you’re 16 and basically have no driving record yet, your insurance premiums are going to be sky high. I wouldn’t count on less than $1500-$2000/ Year. Keep your grades high- “B” or better average. Take driver’s ed and driver’s training if your school offers those. Those qualifications might afford you small discounts. If you want to know why young people get stomped for insurance, look at that “yet…” in your last sentence. Everybody breaks rules. Most people get caught once or twice. Every ticket costs not only the fine, but an insurance rate increase for years.

The health insurance will not matter. You need to make sure that no one finds out you are doing this as moving to a state with the intent to defraud is a state felony in most jurisdictions. You also need to make sure that you never tell anyone that you moved to florida to go to school (make no mistake you are defrauding the taxpayers of the great state of florida.) You must say that you moved to florida because you found it nice and only after a year begin to entertain the idea of going to school in florida. Yes the residency requirement is still 12 months. You must file your taxes separately from your parents once you move to florida… Other than that you should not have any problems.

Today i seen a nissan 240sx :P dreamy i know…… and it has to be mine….. i looked at the price and i have the money….this will be my first car and at 19 i would love to know the steps in buy this car…….What i would like to do is ,go to this car call the number, have this person meet me, test drive it, state that i want it, buy it, sign pappers, and drive it 20 mins to the house and get it plated ans stuff the next day……. I’m not American, so I pre-apologize for a lack of experience with tags and applicable local laws.

However, I noticed two priorities missing from your quest. I know you want the car badly as I’ve felt the same thing every time I saw a real ‘looker’ of a certain vehicle.

A) Obtain the VIN(Vehicle Identification Number) from the vehicle owner and have it checked out at a registry office. You would want to make sure the vehicle is clear of bad titles and liens. If the owner doesn’t want to release the VIN to you, I would be worried already.

B) A test drive is a basic measure, but beware that a lot of negative things can be missed from the shear excitement of the moment and a possible lack of mechanical aptitude. A vehicle inspection report is crucial(if the VIN clears at this stage). I can’t assert how important this is. It’s prudent that you know the vehicle’s health in all aspects. I’d recommend a “full” check with compression testing and so forth, not just the budget check-up for basic insurance purposes. I always believe that the buyer should include one with the sale, but it’s not their problem and rarely anyone does or so it would seem(hmmm, I wonder why?..) This is tricky, because the seller may forfeit an inspection due to no insurance on the vehicle. However, there might be a mobile mechanic that you can call out.

I just had to offer some advice that I didn’t follow in the past and it made my “awesome” purchase turn into an absolute nightmare. After all, it’s your money… But, spend it wisely. :)

How much do a couple pay on an average for car insurance premiums in Northern NJ?
I am insured with liberty mutual and my monthly commitment is close to $140, I have a clean driving history and no claims in the past.
Culd you suggest how I cut down on my premiums? Also the best car insurance company in the tri state area.

Call a few independent agents in your area. Look in the yellow pages to find them. Get multiple quotes. Make sure you get quotes for the exact same coverage with each one. Different companies have different rates. Other than that, if you have comprehensive and collision coverages, consider raising your deductibles. Liberty may offer a discount if you go to EFT (electronic funds transfer out of your checking account) payments or quarterly payments (their sister company Peerless does this).
Actually $140 a month (counting installment fees) is only $1680 per year & if that is for 2 cars in NJ that is an excellent rate. I pay almost that for 2 cars in rural New England (about $1300+-) with a home/auto package discount.
When I left NJ 14 years ago, anything less than $1000 per vehicle was considered a good rate, and that was liability only. I paid $1400/yr for full coverage on one car (when I was single) 20 years ago.

ok the situation is like this.

my family has two cars. (maxima and accent)
I (21years old) use the accent and my parents use the maxima.
All three of us are under the same insurance plan.

I might sell the accent and buy a used car and pay monthly(financing).
so that means the insurance has to be full coverage right? and not liability. (the maxima and the accent are both fully paid and they are under liability right now)

So if I buy a used car what is the best way to minimize the insurance cost?…which is a good insurance company? can I be covered under my dad’s name or something? my friend said something like that..but I don’t know if there is such a thing.

our mustang just got totaled, and we didn’t get a lot of money for it (by our insurance company). yeah bad news after just having it for 4 years. we are looking for a reasonably priced car, good gas mileage, but since we live in upstate NY we need a car good for snow/blizzard and is best for where i live. we would like it to be under $10,000 but most perferably under $7,000. PLEASE HELP!!

P.S. i want a car, not a jeep etc., and we would like it to be stick, just like the mustang. PLEASE HELP!

Why dont you buy another Mustang? If you liked it and you didn’t get much money from the insurance company (since they determined that those vehicles aren’t worth much) you should be able to buy another one for cheap.

That being said, cars with front wheel drive perform better on slippery roads.

I had a Saturn with a stick that I loved, my sister still drives it and it is well past 130K miles. Honda, Toyota, Nissan, Saturn are all reliable cars that have low end models that you can get a few years old for reasonable price.

Immigration to Canada from NY, best course of action?

I’m a 20 year old female (21 in March 2011) living in upstate NY. I currently live at home with my parents, while working at Wendy’s part time. I am in college, however I am currently taking the semester off (only this one semester-fall 2010, I have been continuously in school since graduating high school in 2008, and I have a relatively high GPA [somewhere around 3.2-3.5] so acceptance into my Canadian college of choice should not be difficult) in hopes of saving up money. I have my own car in my name, as well as the insurance and everything else going with it, and within 6 months to a year I should have saved up enough money to afford living costs in canada for up to 12 months continuously if living with my girlfriend.
I am currently discussing with my parents (for their financial assistance) attending Loyalist college in Belleville, ON starting in Fall 2011 if all goes well.
I understand that I would need a Student visa, etc to do this, but I have a bit of a predicament.
I have always wanted to move to Canada, and I hope to become a permanent resident and then citizen in the near future.
I am in a conjugal relationship with another Female who is a 23 year old Canadian citizen, who lives in Carrying Place, ON (near Trenton, ON). In roughly a year or so we plan on getting engaged (we’re waiting until school is sorted out for the two of us) and then married within the next 2-3 years. Unfortunately she does not qualify to sponsor me at the present time, as she is on welfare (a necessity, therefore I will not elaborate on it).
So I do have dual intent on attending school as well as becoming a permanent resident/citizen afterwards/possibly during the rest of my schooling career.
Essentially my inquiry is, how should I go about becoming a permanent resident/citizen, what is the easiest route, and what will I need to do this?
I’ve read through site after site and pamphlet after pamphlet on visas/residency/immigration but I am still unsure about the best course to follow. Can anyone help me?
I have been studying foreign languages so far in hopes of becoming an interpreter, but I have decided to change my course of study to Arts and Art Design at Loyalist, so I can take more Art courses at better universities/colleges after (not sure where I will be going after Loyalist to get a degree), and French. So I wouldn’t exactly qualify for a skilled trade.
Also, I cannot live with her as she is a Canadian citizen and I am a US citizen living in NY, and I cannot get married in NY to another woman, so it would be a conjugal relationship, until I could move to Canada, or marry her there, but I would not be able to move there until I was a citizen, which would be difficult unless I can move there now so that I can live with her for a year to prove my relationship

If you move to Canada to study, you have to get a study visa, which means much higher fees, x2, and a limit on where and how much you work.

Edit: you apply for the university first, then the visa.

You don’t qualify to immigrate until you have a degree, a skill or profession and work experience. Then you can apply. The application takes 2-3 years if you are accepted.

Arts and Design aren’t in demand. I’m sorry to say that interpreting isn’t either, as so many people are multilingual in Canada.

Best thing to do, is pay cash for your car – drive something at LEAST six years old, and don’t carry collision or comprehensive on it. That will seriously decrease your costs.

For young drivers, I’ve seen the collision cost MORE than the liability. So by driving a paid-for car, you can cut the cost of insurance IN HALF.

Your best bet would be to get insurance under your parents household, but ask to be not listed as drivers of their vehicles, that way it won’t drive their rates up too far.
If that is not an option, I would go to a cheap local independent agency, and just get liability. I know those ads on TV are misleading, saying they will all save you money, and not as cheap as they claim to be, even with the cute mascot and all (they pay a lot for TV ads).
You can always call a local brand name agent, for a quote. Quotes and questions are free you know. Good luck.
